National Code now mandatory

The Code took effect on 1 January 2012. All Corridor Managers and Utility Operators should be following the procedures outlined in the Code for access to the transport corridors

The only version of the Code to be used is annotated "approved 10 November 2011".  No other version of the Code can be used.  During the approval process changes were made to the version of the Code that was submitted to the Minister on 11 August 2011.

Use of forms (Appendix A of Code)

Corridor Managers and Utility Operators should now be using the CAR and other forms provided in the Code, including the template of Reasonable Conditions.

Liaison meetings (Section 2.7.2 of Code)

NZUAG Inc recommends that Corridor Managers, if they have not already done so, initiate their liaison meetings promptly to provide an opportunity to discuss with Utility Operators and their agents how the provisions of the Code will be implemented in their areas.  This will include discussions on any proposed Local Conditions.  These must be agreed with Utility Operators before a Road Corridor Manager can include them with the Works Approval Notice (section 4.5.3).

NZUAG Inc recommends that Road Corridor Managers ensure they invite the Corridor Manager of any rail network in their area to such liaison meetings.

Quality Plans

Utility Operators should now have Quality Plans in place to ensure that all works carried out on their behalf are in accordance with the Code.

Location of utility assets (section 2.8 of Code)

Utility Operators need to ensure they keep accurate records of the location of their assets.  They must provide details to Corridor Managers of the presence of any assets in their transport corridors.

Disclosure of conflicts of interest (section 2.6 of Code)

Local Authority Corridor Managers should have procedures in place to manage their council's conflict of interest in being both a Corridor Manager and a Utility Operator (mainly of water assets).  This includes advising all local Utility Operators of the procedures to be followed in that council for processing CAR applications.

Utility Operators who provide more than one utility service (eg telecommunications and electricity) must also manage this conflict of interest.

Key performance data (section 8.2.2 of Code)

Corridor managers are reminded that they need to maintain data on the numbers of CARs submitted each year, as well as Works Completion Notices issued, disputes and third party damage incidents reported.
